Understanding the Proposed SEND Changes - and How We Can Help
The Government has set out proposals to reform the SEND (Special Educational Needs and Disabilities) system in England. These changes are expected to be introduced in phases from 2029 onwards, subject to legislation and ongoing consultation.
While the full legal framework is still being finalised, the proposals indicate significant changes to how children in mainstream schools receive support.
What Is Being Proposed?
1. Education, Health and Care Plans (EHCPs) Will Continue, but for More Complex Needs
EHCPs will remain part of the system. However, they are expected to be focused on children whose needs require specialist or highly complex provision beyond what mainstream schools can ordinarily provide.
Existing EHCPs will not be removed abruptly, and transitional protections are expected to apply.
2. A New Statutory Individual Support Plan (ISP)
All children identified with SEND in mainstream schools are expected to have a statutory Individual Support Plan (ISP).
These plans will:
- Be legally recognised
- Be managed and delivered by schools
- Set out the support a child should receive
ISPs are designed to strengthen accountability within mainstream settings. However, they are different from EHCPs and may not carry the same funding and placement guarantees.
3. Tiered Support Within Mainstream Schools
Support is expected to operate through graduated levels (often described as universal, targeted, and specialist or enhanced provision). Schools may develop inclusion bases or small-group interventions to meet a wider range of needs internally.
What This May Mean for Families
Depending on a child’s level of need:
- Some children may continue with an EHCP.
- Some children may move from an EHCP to an ISP following review.
- Others may receive support through the new statutory ISP framework without ever having had an EHCP.
For families, this could mean:
- Greater reliance on school-led provision.
- Reviews at key transition points (e.g. primary to secondary).
- The need to understand changing thresholds and rights.
Parents are expected to retain legal rights to challenge decisions and appeal where necessary.
